In terms of the Information Technology Act, 2000, this document is an electronic record. Being generated by a computer system it does not require any physical or digital signatures. This document is published in accordance with the provisions of Rule 3(1) of the Information Technology (Intermediaries Guidelines) Rules, 2011.

 

1.1   The online portal www.iniminis.com (hereinafter referred to as "the Website") is owned by Varsha Gulati.

 

1.2  For the purpose of these Terms of Use, wherever the context so requires:"You" or "User" shall mean any natural or legal person who has agreed to become a user by accessing the Website and the contents therein.The terms "We", "Us", "Our" shall mean the Website or "Iniminis".

 

1.3  By using the Website, You accept and agree to be bound by these Terms and Conditions and the Privacy Policy (together, the "Agreements"). Your continued use of the Website is conditioned upon your compliance with the Agreements.

 

1.4  Persons who are "incompetent to contract" within the meaning of the Indian Contract Act, 1872 including minors and un-discharged insolvents are not eligible to independently use the Website. Purchases for minors must be made by a parent or legal guardian.

3.1  You are required to read and accept all terms and conditions before using our Website. The Website allows you to browse, select and purchase educational busy binders and related products.

5.4  You understand and agree that Iniminis is not responsible for any defect, delay or interference in the use of payment gateways while making payment for a transaction.

 

6. SHIPMENT & DELIVERY

 

6.1  Orders shall be processed only upon receipt of successful payment. Delivery shall be made within 5 to 7 business days of order confirmation, subject to your location and courier partner availability.

 

6.2  Iniminis shall not be responsible for any delay in delivery caused by the logistics partner, natural calamities, or other circumstances beyond our control.

 

6.3  Iniminis shall not be liable for any damage to the product in transit due to mishandling by the logistics partner.

 

7. AVAILABILITY

All products are offered for sale subject to available stock. If an item is out of stock, you may request to be notified when it becomes available again. Such a request does not guarantee that you will be able to complete a purchase and is still subject to availability.

 

8. WEBSITE ACCESS

 

8.1  Iniminis grants you a limited, non-exclusive license to access and make personal use of the Website. This license does not include:

•         Downloading or copying of account information for the benefit of any third party.

•         Uploading or transmitting any content that contains software viruses or malicious code

•         Use of data mining, robots, or similar data extraction tools

•         Any unauthorized hypertext links or framing of Website contentAny unauthorized use shall terminate the          license granted to you by Iniminis.

9. PRICING INFORMATION AND PAYMENTS

 

9.1  All prices are listed in Indian Rupees (₹). Prices and availability are subject to change without prior notice.

 

9.2  In the event that a product is listed at an incorrect price due to a typographical or system error, Iniminis may, at its discretion, contact you for instructions or cancel your order and notify you of such cancellation.

 

9.3  While availing any payment method available on the Website, Iniminis will not be responsible for any loss or damage arising directly or indirectly due to:Lack of authorization for any transactionExceeding the preset limit agreed between the User and their bankAny payment issues arising out of the transactionDecline of transaction for any reason

 

10. CANCELLATION OF ORDERS

 

10.1  Iniminis reserves the right to refuse or cancel any order at its sole discretion. Situations that may result in cancellation include limitations on available stock, errors in product or pricing information, or concerns identified by our fraud prevention process.

 

10.2  If a cancellation notice is received before the order has been processed, we shall cancel the order and refund the entire amount. If the order has already been dispatched, our Refund & Return Policy shall apply.

 

11. LIMITATION OF LIABILITY

 

11.1  Iniminis and its owners, employees and partners shall not be liable for any direct, indirect, incidental, special, consequential or punitive damages arising from the use of the Website or purchase of products, including but not limited to loss of profits, data, goodwill or other intangible losses.

 

11.2  In the event that applicable law does not permit exclusion of liability, the liability of Iniminis shall be limited to the amount paid by the User for the transaction in question.

 

11.3  Iniminis is not responsible for unsatisfactory or delayed performance of services due to products being out of stock, back-ordered or otherwise unavailable.

 

12. INDEMNITY

 

You agree to indemnify, defend and hold harmless Iniminis and its owners from and against any losses, liabilities, claims, damages, costs and expenses arising out of:Your breach of these TermsAny claims made by any third party due to your use of the WebsiteViolation of any rights of any third party by you, including intellectual property rights

 

13. INTELLECTUAL PROPERTY RIGHTS

All content on www.iniminis.com including text, graphics, logos, images, product designs and computer code is owned by or licensed to Iniminis and is protected by applicable copyright, trademark and intellectual property laws. No part of the Website or its content may be copied, reproduced, republished, uploaded or distributed in any way without the prior written permission of Iniminis.

 

14. PRIVACY POLICY

You confirm that you have read and fully understand the Privacy Policy of Iniminis in respect of the Website and that the terms of such Privacy Policy are acceptable to you.

17. DISPUTES

The formation, interpretation and performance of this Agreement and any disputes arising out of it shall be governed by the laws of India. The exclusive jurisdiction and venue for actions related to the subject matter hereof shall be the courts located in Delhi, India.

18.1  Notice: All notices from Iniminis will be served by email to the address designated by you or by general notification on the Website. Any notice to be provided to Iniminis should be sent to customer@iniminis.com.

 

18.2  Assignment: You cannot assign or transfer these Terms or any rights hereunder to any third party.

 

18.3  Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

 

18.4  Waiver: Any failure by Iniminis to enforce any provision of these Terms shall not constitute a waiver of that provision or right.

 

18.5  Force Majeure: Iniminis shall not be liable for any failure or delay in performance arising from causes beyond its reasonable control, including but not limited to acts of God, floods, earthquakes, war, strikes, utility failures, government orders, hacking or other disruptive events.
